The cases in which a delay in delivery can be said to exist are clearly defined
Suppose the purchasing management of a car manufacturer orders exhaust gas recirculation valves from a supplier, which are used to reduce environmentally harmful pollutants, and sets a definable date for delivery. After the order confirmation has been received from the supplier, in which he confirms the delivery date without clauses such as "subject to reservation", this date is fixed for the delivery. If the day arrives after the set date and the supplier has not delivered his goods, he is in default of delivery. The car manufacturer may be restricted in its production and has to reschedule. Perhaps he has already agreed a production date with a customer for all cars, which he can no longer meet. This results in unnecessary additional costs and, in many cases, an enormous amount of time.
